1. Introduction

This Privacy Policy explains in detail how AILabTools ("we", "us", or "our") collects, uses, processes, stores, shares, and protects personal data when you access or use our websites, applications, APIs, and related services (collectively, the "Service").

The Service provides AI-powered image processing and related functionality, which may involve the temporary handling of user-uploaded content. We are committed to processing such data in a lawful, transparent, and purpose-limited manner, and to implementing reasonable technical and organizational measures to protect data against unauthorized access, misuse, loss, or disclosure.

2. Scope of Application

This Privacy Policy applies to all interactions with the Service, including but not limited to:

  • Visitors browsing our website
  • Registered and unregistered users
  • Free trial users and paid subscribers
  • API users and enterprise customers
  • Communications with customer support, including inquiries, refunds, and dispute resolution

This Privacy Policy does not apply to third-party websites, applications, or services that may be linked to or integrated with the Service. Such third parties process data in accordance with their own privacy policies and practices.

3. Definitions

  • User Content: Any content uploaded, submitted, or transmitted by users through the Service, including images, mask files, prompts, processing parameters, and related metadata.
  • Generated Content: Any output produced by the Service as a result of processing User Content.
  • Processing: Any operation performed on data, whether automated or manual, such as collection, recording, storage, use, disclosure, deletion, or anonymization.
  • Controller / Processor: The meanings assigned to these terms under applicable data protection laws.

4. Categories of Data We Collect

4.1 Account and Contact Data

When you create or use an account, we may collect information necessary to establish and maintain your account and to communicate with you regarding the Service.

  • Email address
  • Account identifiers
  • Encrypted authentication credentials

4.2 User Content Data

In order to provide AI image processing functionality, the Service processes content and parameters that you actively submit.

  • Uploaded images and mask files
  • Prompts, processing options, and configuration parameters
  • Technical metadata required to perform image processing (such as image dimensions or file format)

User Content is processed solely for the purpose of performing the specific operation you request and delivering the corresponding result to you.

4.3 Generated Content

Generated Content consists of images or other outputs produced by the Service based on your User Content. Generated Content is treated as user data and is handled in accordance with this Privacy Policy.

4.4 Technical and Usage Data

To operate, secure, and improve the Service, we may automatically collect certain technical and usage information.

  • IP address
  • Browser type and version
  • Device and operating system information
  • Timestamps, page views, and interaction logs
  • Error reports and performance metrics

4.5 Payment and Billing Data

If you purchase paid services, payment and billing information is processed to complete transactions and comply with legal obligations.

  • Billing country or region and tax-related information

Payment card details are processed directly by third-party payment providers. We do not store full payment card numbers or security codes on our systems.

5. AI Data Processing

5.1 Use of User Content

User Content and Generated Content are processed only to provide the functionality explicitly requested by the user. Processing is generally automated and limited to the duration necessary to complete the requested task.

5.2 Model Training

We do not use User Content or Generated Content to train, fine-tune, or improve artificial intelligence or machine learning models, unless we have obtained explicit and separate consent from the user.

5.3 Access Restrictions

Access to User Content by personnel is restricted and permitted only where necessary for system security, troubleshooting, or compliance with legal obligations.

5.4 Data Isolation

User data is logically isolated. User Content and Generated Content associated with one user are not shared with or made accessible to other users.

6. Purposes and Legal Bases for Processing (GDPR)

If you are located in the European Economic Area, we process Personal Data under the following legal bases:

7. Analytics and Session Analysis

7.1 Google Analytics

We use Google Analytics to collect aggregated statistical information about how users interact with the Service. This helps us understand usage patterns, identify technical issues, and improve the overall user experience.

7.2 Microsoft Clarity

We use Microsoft Clarity to analyze user interactions with our web pages, such as scrolling behavior and click patterns, in order to improve usability and performance.

Session recordings generated by Microsoft Clarity are used for analytical purposes and are not intended to directly identify individual users.

8. Cookies

Cookies and similar technologies are used to operate the Service, remember user preferences, perform analytics, and support security-related functions. You may control or disable cookies through your browser settings, although some features of the Service may not function properly if cookies are disabled.

9. Data Retention

We retain data only for as long as necessary to fulfill the purposes described in this Privacy Policy or to comply with legal obligations.

  • User Content: automatically deleted within 24 hours
  • Generated Content: automatically deleted within 24 hours
  • Account data: retained until the account is deleted
  • Usage and security logs: retained for a limited period
  • Financial and transaction records: retained as required by law
  • API File Upload Storage Policy: For files uploaded by developers via our API, we enforce a more stringent strategy. Once processing is complete, the original file will be immediately deleted. If the response after processing is an image URL, we will retain it for a maximum of 24 hours. After this period, the result image will be promptly deleted. 10. Account and Data Deletion

You may delete your account and all associated personal data at any time by following these steps:

  • Go to your Dashboard / User Center.
  • Click the "Delete Account" button.
  • Your account and all associated personal data will be permanently and irreversibly deleted immediately upon confirmation.

After account deletion, the account will be permanently deactivated. Personal Data will be deleted or irreversibly anonymized, and User Content and Generated Content will be removed in accordance with the retention periods described above. Certain information may be retained where required by law or necessary for compliance, accounting, fraud prevention, or dispute resolution.

11. Data Sharing

We may share limited data with service providers that support the operation of the Service, including payment processing, analytics, cloud infrastructure, and security services. Such providers process data only on our instructions and subject to contractual confidentiality obligations.

We do not sell personal data.

12. International Data Transfers

Personal Data may be processed or stored outside your country or region of residence. Where required by applicable law, appropriate safeguards are implemented to ensure lawful cross-border data transfers.

13. Your Rights

Depending on applicable law, you may have rights to access, correct, delete, restrict processing of, or request portability of your Personal Data, and to withdraw consent where processing is based on consent.

14. California Privacy Rights (CCPA / CPRA)

California residents have rights to know what personal data is collected, to request deletion, and to opt out of the sale or sharing of personal data, where applicable.

15. Data Security

We implement reasonable technical and organizational measures to protect Personal Data against unauthorized access, loss, or misuse. However, no system can be guaranteed to be completely secure.

16. User Responsibilities

Users represent that they have all necessary rights to upload User Content. Users are responsible for the content they submit through the Service.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated revision date. You are advised to review this Privacy Policy periodically for any changes.
